Why doesn't Nintendo?

Because Nintendo is unaffected and are a different entity. Very Wii vs ps360. Switch is like a handheld (DS) and console (Wii) come together so they aren’t as affected. Also because their games are exclusive and only on Nintendo platforms for the most part. We shall see what happens but they have already responded by adding SNES and N64 games to their online to get people to sign up.

The ps5 has nearly outsold the Xbox series by 2 to 1 and this is where Xbox series S's can be easily brought, unlike the Xbox series X or either of the PS5's.
Why would they want to copy something that is doing worse

Well with Game pass Microsoft platform also includes PC, Cloud and Mobile not just the console and that makes Gamepass market share much greater then PS5 will ever get and why they need to consider a solution.

Sony Interactive Entertainment boss Jim Ryan has said he’s frustrated at how PlayStation’s first-party games are ‘gated’ to their current console model audience of tens of millions of players.

Even Sony executives want to see their game open up to a bigger market and not being gated by platform sold.

SNY also 'needed to directly respond to XB1 BC asap' with PS4, and they certainly didn't. They did their own thing and it worked wonders. They even launched PS5 without really doing anything about PS1-PS3 BC.

Heck, we just had XB announce even more BC games, and it seems that SNY still isn't too worried about it.

If anything, who needs SNY to respond is MS, because once SNY were to do that, it would extremely legitimize GP in the eyes of console gamers.

*looks at current state of WW sales*

Not yet, no. But if Xbox starts to really challenge them in a serious way, maybe.

How much time do you actually spare by writing SNY instead of Sony ?

Game Pass market share? 20+ Million subscribers is Game Pass actual market share. Less than NSO & PS+ lol. Billions of people having access to Game Pass on PC, mobile, cloud, does not equal market share.

The PS4, for a long time, was tracking ahead of the PS2.

PS5 is falling behind the PS4 because they can't ship enough of them. The demand is clearly there for more sales, but that demand can't be met. XSX selling faster than the 360 is only faster than the 360, which is slower than both the PS4 and PS5.

Back in Feb, Amphere had the following data (millions): XSXS 2.8, PS5 4.2.

Now, for the period ending in September, they have: XSXS 6.7, PS5 12.8. An increase of 3.9 and 8.6 million respectively.

Clearly, the PS5 is selling better.

Yes I have just seen Amphere numbers, that's interesting.

I want my big budget games and MS is yet to release one. This halo seems like the lowest budget Halo to grace a console. Maybe this is an indication of things to come for Gamepass.

I buy my consoles for big budget spectacles that are fun to play and at the moment the only place to get them is on the PlayStation.

Older games and older AAA games I can get on PSNow and PS+ and the best thing is PS+ is for keeps and miles ahead of Games with Gold.

Everyone needs to address something, not just Sony. It is inevitable that PS5 games will come to PSNow. It's not a matter of if but when. However, when will Microsoft address the lack of AAA games that do well? Yes they bought Bethesda to play catch-up, EoS and FO are games which come out once every 10 years. The other games still need to prove themselves.

Sony on the other hand is finally hitting that Nintendo level where their games are starting sell big numbers.

More than doing what gamepass does, Sony needs to start rolling out PSNow onto TVs as an app with Dual Sense support.

The tide isn't turning globally, PS5 still leads Xbox Series by a significant margin. Xbox pretty much needs Game Pass to thrive at all.
While we would win as consumers if PS Now or a new service had way newer games (and they stayed on longer), Sony will almost surely do just fine without adopting such a strategy.
Game Pass is a far better value proposition in terms of the prices you need to pay to buy the games yourself (namely the new releases). PS Now has far more games, though. And many would argue that the first-party titles on PS Now are higher quality than the first-party titles on Game Pass.
Sony needs to improve PS Now, that much I agree. The subscription numbers are super low given how many PS4s are out there, and how many PS5s there will be in the future.
But they probably won't have to make their own Game Pass.
