The link you given says: 'This game will not be available in Germany due to lack of a USK rating.' But no USK-rating mean for 18+, not more. It also mean that the BPjM can put it on the index, that doesnt allow advertising (but it can be sold to adults if they ask especially for it) like RolStoppable explained. But at the moment I dont see, that the BPjM indexed it. So I will wait for more info on that, at the moment it's not clear for me. Amazon.de lists the game with release-date on 30. november. To clarify it, Resident Evil 4 Wii Edition also had no USK-rating, but I could walk into the store and pick it from the shelf. As an adult I was able to buy it.

No, it's not forbidden to import games that didn't get an USK rating. It's also not forbidden to import or sell games which are on the index of the BPjM, as long as these games are sold to adults only. Games which are on the index of the BPjM are not allowed to be advertised, to be on retailers shelves and to be sold to people under the age of 18.

Theoretically an adult can walk into a store and ask for such a game to buy it, but because of the laws (game is not allowed to be on the shelf or advertised that it is in stock), retailers wouldn't sell a lot of copies so they usually don't have these games in stock at all.

In rare cases it happened that videogames weren't just put on the index of the BPjM, but were completely banned, so it's really illegal to sell copies. Examples are the first two Mortal Kombat games and Manhunt.


 You got itwrong: If it has no USK rating it is not allowed to advertise or being on the shelf and can only be sold to 18+. If it is on the "Index" than it is not allowed to be sold AT ALL. But there are very few games actually on the index. If a  court say it can be confiscated that it is not allowed to won the game, but that is a "soft law". 



I can understand that games are not allowed in germany about WWII.

But about zombies?

Zombies = Nazi's ?? Both no brains and wished they had some.

No, Rol is right and you are wrong. No USk-rating mean nothing more that it is allowed to be buyed for adults. BPjM-index means no advertising, no shelf-space. No USK-rating means that the BPjM is allowed to index the game, if the USK rates it, the BPjM can do nothing. Many publishers decide themselve not to release a game that gets on the index or is threatened by it. Gears of Wars wasnt released in germany by Microsoft for this reason. And Doom2 was actually forbidden, but in that case because of the use of nazi-symbols in the wolfenstein-level.

As I read through the news on german sites: First: I as wrong on one point: No USK-rating (as UC has) is not completely the same as 'Keine Jugendfreigabe' (no release for young people) as RE4 got. So the situation for UC is badder as for RE4. and second: As this doesnt mean that it get on the index at the BPjM it may be likely and it seems that Nintendo decided not to release the game for germany (as Microsoft did with Gears of Wars). That's a pity.

These things are a bit pointless in the EU. Unless it's something that you can't even own (like a gun, or something), you can always import it. That's the hole point of the EU.

 So whats the difference of 18+ and no rating from the USK then?

From the Wikipedia:

"Von verschiedenen Seiten wird kritisiert, dass Medien, die nach §15, Abs. 2, Nr. 1–5 JuSchG als „schwer jugendgefährdend“ eingestuft wurden, von der USK keine Kennzeichnung erhalten. Diese Medien müssen laut §15, Abs. 2 wie Werke behandelt werden, die in die Liste der jugendgefährdenden Medien aufgenommen wurden. Kritiker führen nun an, dass diese Werke dennoch, mit den in §15, Abs. 1, Nr. 1–7 beschrieben Auflagen in Deutschland vertrieben werden könnten, beispielsweise als Grauimporte. Auch ein Kauf „hinter der Grenze oder im Internet“ sei denkbar."

So if the USK gives no rating, it has to be handled like porn. If it is on the Index, you are allowed to own one, import one for yourself, but is can't be imported by firms for you (BIG DIFFERENCE). If it is confiscated, you aren't even allowed to own it, but thats a so called "soft law".

So at the moment i can go to a import firm and let it import it for me. (I have to drive far distances to austria). If it is on the "Index" I must drive for my own. 



Germany is one of many western countries that have their own unique take on censorship and content control. Many westernized countries I find are typically either anti Sex and tolerant of violence in media content or the complete opposite, its really quite an odd paradigm.

My condolences to german gamers.



@Just_Ben: Just order it from an austrian company (instead of a german import company.) I did this to get RE4 with bonus content ...
