You got itwrong: If it has no USK rating it is not allowed to advertise or being on the shelf and can only be sold to 18+. If it is on the "Index" than it is not allowed to be sold AT ALL. But there are very few games actually on the index. If a court say it can be confiscated that it is not allowed to won the game, but that is a "soft law".
