No, it's not forbidden to import games that didn't get an USK rating. It's also not forbidden to import or sell games which are on the index of the BPjM, as long as these games are sold to adults only. Games which are on the index of the BPjM are not allowed to be advertised, to be on retailers shelves and to be sold to people under the age of 18.

Theoretically an adult can walk into a store and ask for such a game to buy it, but because of the laws (game is not allowed to be on the shelf or advertised that it is in stock), retailers wouldn't sell a lot of copies so they usually don't have these games in stock at all.

In rare cases it happened that videogames weren't just put on the index of the BPjM, but were completely banned, so it's really illegal to sell copies. Examples are the first two Mortal Kombat games and Manhunt.

 You got itwrong: If it has no USK rating it is not allowed to advertise or being on the shelf and can only be sold to 18+. If it is on the "Index" than it is not allowed to be sold AT ALL. But there are very few games actually on the index. If a  court say it can be confiscated that it is not allowed to won the game, but that is a "soft law".
