I suppose it was bound to happen.
I truly don't believe that. I've seen projects like these succeed on Kickstarter without permission from the IP owners, maybe everyone is right and Nintendo is being extreme about protection right now....it's a dang shame.
But in honor of Christian, Kent, Rebecca, and all the dreamers from Massive State I'm keeping the official movie poster for this as my Avatar. Cause I want to remember the project and hope that one day maybe it'll get made.

I expected this, Nintendo has a general policy of shutting down any fan projects that ask for money be it donations or actual purchase. they aren't too fond of movies either, especially given the Mario movie. Nintendo should let more of these things go on though, perhaps with much negotiations as they would be very interesting

They don't have to be a rival company. A trademark holder MUST legally defend their trademarks in order to maintain them. So if Nintendo does not defend their trademarks when they are notified of the infringement, that DOES mean that Sony or Microsoft can legally use them.
