Forums - Nintendo - Eurogamer: Did Nintendo download a Mario ROM and sell it back to us?

The argument made in the video isn't particularly strong simply for the fact that they only sourced Mario as having this done to it. If this were really true, I would imagine that this would apply to most, if not all, Nintendo VC games.

Why is it "really disappointing"?

Nintendo owns the IP and created the game. Its a little lazy that whoever was tasked with creating the VC version didn't have a copy to dump the ROM from on-hand, but I'm not really sure how this affects people.

Technically this makes Nintendo a pirate. And I think I will buy Zelda botw and rip it in my PC to play (just like Nintendo I am not doing anything illegal).

Lol, no it doesn't. If you worked really hard to steal something from me, and I took it back and sold it, that wouldn't make me a thief, would it.

But yeah, if you can rip BotW ad you paid for it, do it. Nothing wrong with that.

Nope, it doesn't technically make Nintendo a pirate. A copy isn't tagged legal or illegal per se, it becomes illegal if the one using or downloading it doesn't have the rights to do so. Nintendo is the owner of the IP, they can copy unmodified ROMs of their games as much as they want and give someone else the right to do so. Only if the copy was modified, than the modifications get the copyright of the one who did it (if the modifications actually fulfill copyright rules just reformatting or technical changes don't cut it).

this is one of those "we are the owners, so deal with it" situations.

quite funny in my opinion... something like this:

if you don't know the backstory, google is your friend.

That was pretty awesome (both the skit and the fact that prince used it as his single cover lol)

i dont think that makes them a pirate since they own it.

ive never heard of a pirate stealing something that was already theirs.

Yeah try saying that in court, and see how well it works out for you.

Can't watch it, can you please explain it?

Rather than use the data file from their software archives to build the super mario vc package they used a downloaded rom

They own the rights to it either way so it's a non-issue

It's apparently news non the less.

i know lol

Lmao! at first I thought this was a joke but no, the desperation is real.

its for the Wii virtual console, which visually looks kind of poor, so I'm not shocked. That said its their IP and in the end the Mario ROMS ANYBODY uploaded online were taken originally straight from their games, so its sort of irrelevant and kind of semantics

Any ROM posted up is indeed from Nintendo's original game. So if someone does the step for Nintendo then so be it. I've heard some of the Virtual Console stuff was sent to a third party to do so I wouldn't fully necessarily get that bothered over Nintendo regarding it, its not like the heads of the big N were really involved with the decision.

I will mention that its quite obvious the games on the NES Classic are all improved somehow, they look superb compared to the Wii Virtual console. For example Mario Bros 3 on the NES Classic looks like years better than the Wii Virtual Console (very dull and not vibrant color wise)
