its for the Wii virtual console, which visually looks kind of poor, so I'm not shocked. That said its their IP and in the end the Mario ROMS ANYBODY uploaded online were taken originally straight from their games, so its sort of irrelevant and kind of semantics
Any ROM posted up is indeed from Nintendo's original game. So if someone does the step for Nintendo then so be it. I've heard some of the Virtual Console stuff was sent to a third party to do so I wouldn't fully necessarily get that bothered over Nintendo regarding it, its not like the heads of the big N were really involved with the decision.
I will mention that its quite obvious the games on the NES Classic are all improved somehow, they look superb compared to the Wii Virtual console. For example Mario Bros 3 on the NES Classic looks like years better than the Wii Virtual Console (very dull and not vibrant color wise)
