Nope, it doesn't technically make Nintendo a pirate. A copy isn't tagged legal or illegal per se, it becomes illegal if the one using or downloading it doesn't have the rights to do so. Nintendo is the owner of the IP, they can copy unmodified ROMs of their games as much as they want and give someone else the right to do so. Only if the copy was modified, than the modifications get the copyright of the one who did it (if the modifications actually fulfill copyright rules just reformatting or technical changes don't cut it).
