My point is....apps are where Nintendos true threat exists. Whether they can or cannot do anything about it is up to them and the court. The flappy birds creator was harassed over the copyright for the longest and even after he pulled the game down he got death threats and suicide threats. Nintendo has no choice but to face the App issue head on. Now that is some places where they can bring their first party and fill a void which might even attract people ot the DS. Nintendo needs to get with the times. Problem is...they arent.

There seems to be something different about the mobile market... Heck I almost bought Rise of Nations until I saw the low ratings and read the cleverly worded description that made it sound like you'd be playing but really meant you'd watch footage of others playing as a "guide" of sorts.

This is somehow available in the App Store despite seemingly 100% of those who purchased it having felt conned, and the owners of Rise of Nations having nothing to do with it.

Essentially, the mobile market sometimes seems a little lawless... Just look at "gangsta auto thief" (same font and art style as gta). The market is rife with knockoffs.



Remember this image the next time someone gets a DMCA for their content on Youtube.

Protecting your IP only means something when others stand to make money off of it.

EDIT: By the way, Nintendo owns 1/3 of Pokémon with Game Freak and Creatures Inc. owning one-third each.

My point is...Nintendo has no choice but to face the App issue head on. They may or may not have any right to copyright claims, but the imminent threat of posers and app popularity cannot be ignored. TImes are changing and Nintendo needs to get with it. Analysts have been talking about this for a while now. Now that there are some places where they can bring their first party and fill a void which might even attract people ot the DS if they want to upgrade to newer versions of old games. If they do this, it would mean they would finally have recieved the memo. In a nutshell Nintendo needs to compete with the mobile market face to face to combat the knock offs. As you said...there is no automated system to find clones. You can even find emulators on the app market.

Well the YouTube is partly the result of Nintendo, but also largely the result of YouTube's copyright claim bot system. It's really dumb. People have gotten copyright claims on their own videos from themselves for music they created. And some have had to write letters of permission for themselves to use said materials. This is pretty much why many companies use the claim system on YouTube sparingly; it just causes stupid problems.
