Forums - Sony - 'That isn't Kevin Butler', Bridgestone claims

The only way Sony has a chance if is there is a written clause on the contract explicitly stating that the actor in question cannot do other video game commercials (for other companies) for an X amount of time.

If not, this case is dead in the water. Kind of reminds me when wrestlers "Razor Ramon" and "Diesel" went from WWE to WCW. They looked and acted the same (except they were using their real names) and the WWE couldn't do shit about it.

What character likeness for god's sake... it's the guy dressed as a nameless tyre engineer in a tyre factory saying nothing at all!

What character likeness???

Except he did say somthing. I don't think you are well enoughed informed to discuss such matters

Oh, yeah... I forgot the ad, he says something. Doesn't change a thing though as it's not in Kevin Butler's "likeness". Guy is a goofy in the ad.

It was not a joke though, that is what the internet ran with, it did damage to the PS brand and the Kevin Butler character, as said, the advert doesn't do enough to seperate Lambert from the Kevin Butler character.

So nowadays we sue individuals based on the stupidity of the interwebs. As for doing enough to separate Lamber from KB, what were you expecting them to do, but a sign on his face saying "I am not KB?". I know this is a silly question, but what apart from playing a Wii (which obviously the KB char would not be doing) would separate him in your opinion?

Not using him in this particular commercial for one. Or instead of playing the Wii have him be the one asking whats going on.

It's like that time Marvel got ripped off by NewLine Cinema when they used Magneto in Lord of the Rings.

Hey Marvel isn't in the clear, they used Captain Picard in their X-men movies. They should be sued!

Marvel should totally sue Marvel though. They used the Human Torch in Captain America's movie.

Where'd you get your law degree from?

What I thinks makes Kevin Butler Kevin Butler is the way he acts. His sarcasm and whatnot (fwiw, I always liked the KB ads) is what made him funny to me. Now I didn't see the tire ad but I can't imagine he's doing the same shit. I don't think him holding a controller of any type is what stands out about his character, it's the things he says and the way he acts.

I wouldn't be surprised however if there are some kind of laws that help Sony out in this instance even though I think it's silly.

I LOVE paying for Xbox Live! I also love that my love for it pisses off so many people.

Kevin Butler is goofy. Kevin Butler is associated with video games. Kevin Butler looks like bridgestone engineer. Now Lambert's acting style is goofy and both roles are played by him. Obviously, those are due to the actor and his roles wont really change. That's why I think Bridgestone shouldn't have used him in this commercial. At the same time the removal of him in the commercial should have been enough for Sony. I'm sure a judge will take that into consideration if it gets that far.

I demand Jerry Lambert to kill Kevin Butler making him commit public sudoku so this discussion can end.

Is not stupidity of the internet.  Think of Jerry Lambert and video games, what will everyone get?  Kevin Butler.  What to do to seperate him?  Well the obvious choice is to just not be in an advert playing a Wii, when celebs get these Pepsi type deals and they go to a bar that only serves Coca-Cola, the smart thing to do is just not order a drink, or get water.  Otherwise Lambert could have introduced himself as someone other than Kevin Butler, to make it clear he isn't.  Instead people see Jerry Lambert playing a videogame and are instanty lead to believe it is the Kevin Butler character, and the internet proves this was the majority reaction.

Then the non compete clauses are stupid and unnecessary, as by your reasoning, he can't do ever any ad related to videogames.

I have to agree with Turkish here.
You may hate me and disagree all you like but this is how I see it.

Take this into consideration. I'll explain it as simple as possible. A well known coca-cola mascot wearing a nike logo is seen promoting a nike commercial that is also giving away free pepsi with every purchase.

For coca-cola that is like a low blow.
