It was not a joke though, that is what the internet ran with, it did damage to the PS brand and the Kevin Butler character, as said, the advert doesn't do enough to seperate Lambert from the Kevin Butler character.

So nowadays we sue individuals based on the stupidity of the interwebs. As for doing enough to separate Lamber from KB, what were you expecting them to do, but a sign on his face saying "I am not KB?". I know this is a silly question, but what apart from playing a Wii (which obviously the KB char would not be doing) would separate him in your opinion?

Is not stupidity of the internet.  Think of Jerry Lambert and video games, what will everyone get?  Kevin Butler.  What to do to seperate him?  Well the obvious choice is to just not be in an advert playing a Wii, when celebs get these Pepsi type deals and they go to a bar that only serves Coca-Cola, the smart thing to do is just not order a drink, or get water.  Otherwise Lambert could have introduced himself as someone other than Kevin Butler, to make it clear he isn't.  Instead people see Jerry Lambert playing a videogame and are instanty lead to believe it is the Kevin Butler character, and the internet proves this was the majority reaction.

Then the non compete clauses are stupid and unnecessary, as by your reasoning, he can't do ever any ad related to videogames.
