The only way Sony has a chance if is there is a written clause on the contract explicitly stating that the actor in question cannot do other video game commercials (for other companies) for an X amount of time.
If not, this case is dead in the water. Kind of reminds me when wrestlers "Razor Ramon" and "Diesel" went from WWE to WCW. They looked and acted the same (except they were using their real names) and the WWE couldn't do shit about it.
