The point in hacking it for homebrew is, that any software can be executed, not only licensed. Therefore if homebrew is possible, pirated copies can be played too. That doesn't mean it is simple to create a pirated copy in the first place. The hacking of the device may allow also copying games on it - or not. In the second case someone in the world must find a way to copy it in another way (should be possible if you open the device and add some wiring) and share this copy with the world. If such a copy exists, it can be executed if homebrew can be executed.
