Once again though. A motion controller, there's leeway as to its functions and how you hold it. For comparison, here's an interesting pic. This does not require an explanation. Sony may have been prototyping, but its final build pulls enough from the Wii as inspiration to call it a rip-off. It's the same thing with PASBR.

First off, the prototype you see doesn't have any button, to my knowledge didn't use accelerometers, didn't have a secondary nunchuck controller, and didn't have the same form factor as the final product. Second of all, companies have tons of prototypes at any given time.
So, Sony had a vague idea that maybe a motion based controller would be a good idea. They did some research on the idea, couldn't get it to work properly, and quietly threw it in some drawer in their R&D department.
Meanwhile, Nintendo had an idea that a motion controlled peripheral would be a good idea. They developed several prototypes, continually refining the product. They came up with a nunchuck attachment to accomodate more traditional games, and they developed software to show off their new hardware. Then, Nintendo decided to risk their whole financial future on their motion controller. They bundled it with their newest console, devised an advertising plan, and crossed their fingers, knowing that failure could be absolutely catastrophic. Luckily, their hard work and planning paid off. The Wii was a Smash hit, thanks largely in part to the simple but addictive Sports game that was included, and Nintendo overtook both Sony and Microsoft to claim the number one spot in the console market. They took a huge risk and reaped a huge reward.
Sony saw this success Nintendo was having and thought "oh what do you know. Motion controls really are a viable idea. Let's hitch a ride on the bandwagon. What ever happened to that prototype we abandoned?" So, Sony took their old prototype, molded it until it looked like a Wiimote, added a nunchuck attachment, made their own sports game, and hoped to see the same success Nintendo saw while taking none of the risk or putting in any work or creativity of their own. Sony had an incomplete Idea and they used Nintendo's work to flesh it out.
Edit: And btw I disagree with your idea of "similar looking". The Wii-mote looks like a remote controle. The protomove looks like a bloated lollipop.
