Redundant title
Apple have done this stuff before. I forget the name but sure it would be findable. There is a developer who makes fighting style games using humanized rabbits. Someone uploaded a pirated version of his game to the appstore and Apple approved it, took weeks to take it down and then didn't compensate the developer at all for the fact they had sold an illegal copy of his game making him lose sales. Will have to google it and see if I can find it again.
Have to slightly laugh at the people who are saying they were ripped off. A Pokemon game for under a dollar, being published by a company called Home of Anime? Blatantly not a Nintendo product and illegally there. They were happy to download it when they thought the person had just uploaded the game illegally but when it doesn't actually work? Oh then it's an issue. In fact they aren't even complaining that it isn't a Nintendo product, they are just annoyed that the illegal copy they bought doesn't work!

Basically they made the source code available so people could easily mod the game. Someone took it and simply submitted the EXACT same game to Apple. Instead of charging $10 they charged $2. The developer filed a complaint on 31st of January. Apple didn't even respond until the 3rd of February. Then didn't bother taking the illegal copy off the store until the 10th of February. By which point it had hit number 60 on the charts.
I can't find any mention of Apple compensating Wolfire for having sold an illegal copy of their product. In fact the lastest story I can find states that after getting the initial response from Apple that Wolfire didn't her anything from them. It's really no surprise Apple are an utterly disgusting company when it comes to dealing with customers rights or any developers they work with.

Not everybody has a clue on who is developer/publisher or anything. They just know waht pokemon is. THey know what Call of Duty is, they know what ______ is. The people who can list a game and what publisher or developer is for it are a very small majority
Oh god, why would people buy it? What makes people think Nintendo are ever going to release pokemon on iOS? Why wouldn't you realize its a scam just by looking at the name of the app developer? What were Apple smoking when they allowed this app to go on iOS? Can Nintendo sue? If so who, the game developer or Apple?

First, I doubt many people even looked at the author. Second, I think you would be surprised at how many people had no clue who made Pokemon.

No, Apple should be observing everything they put on their store. I wouldn't blame the consumer if this happened on PSN or Live either.
Apple profits on everything sold so they should have people testing apps before they are added.

Are you presuming the average iPhone user is as savvy as you?
Perhaps people were under the illusion the Apple store has some quality control.

Funny, I was thinking about this a little more while at work. If Nintendo somehow released a fake Apple IP on their market (not going to happen but let us just pretend) then you should know Apple's first response would be. They would send about two dozen lawyers over to knock on Iwata's door. However, since this is the all fucking mighty Apple they can just let this shit slide right under the rug. Pretty bullshit double standards if you ask me.

This is part of my point!
If you have a process and continually allow things through, then one has to conclude that (a) you are not good at your job or (b) you are manipulating the situation for your own advantage. In this case, allows the "Pokemon Yellow" "game" weakens a rival for mobile gaming (at some level) by allowing a faux representation of their work to be posted. It may color the opinion that gamer has of Pokemon and Nintendo, causing them to look elsewhere for their entertainment.
