Apple have done this stuff before. I forget the name but sure it would be findable. There is a developer who makes fighting style games using humanized rabbits. Someone uploaded a pirated version of his game to the appstore and Apple approved it, took weeks to take it down and then didn't compensate the developer at all for the fact they had sold an illegal copy of his game making him lose sales. Will have to google it and see if I can find it again.

Have to slightly laugh at the people who are saying they were ripped off. A Pokemon game for under a dollar, being published by a company called Home of Anime? Blatantly not a Nintendo product and illegally there. They were happy to download it when they thought the person had just uploaded the game illegally but when it doesn't actually work? Oh then it's an issue. In fact they aren't even complaining that it isn't a Nintendo product, they are just annoyed that the illegal copy they bought doesn't work!

Basically they made the source code available so people could easily mod the game. Someone took it and simply submitted the EXACT same game to Apple. Instead of charging $10 they charged $2. The developer filed a complaint on 31st of January. Apple didn't even respond until the 3rd of February. Then didn't bother taking the illegal copy off the store until the 10th of February. By which point it had hit number 60 on the charts.

I can't find any mention of Apple compensating Wolfire for having sold an illegal copy of their product. In fact the lastest story I can find states that after getting the initial response from Apple that Wolfire didn't her anything from them. It's really no surprise Apple are an utterly disgusting company when it comes to dealing with customers rights or any developers they work with.
