in reality at that point this doesn't matter as it probably turn into  person 1 said vs person 2 said scenario.

If they can't give informed consent then it's rape.

On a serious note though, I haven't drunk to the point of blackout since that incident. I used to do it on a weekly basis back in those days, to self-medicate the anxiety stemming from my autism and because I was depressed. I did a lot of stupid and dangerous shit back then. I'm very lucky to have gotten through it with as little permenant damage as I have.

It's more situational than that in my opinion. If a woman is so drunk that she passes out or can be barely stay conscious, she's beyond the point of being able to consent and it would be rape if you tried to have sex with her.

If a woman is tipsy or just drunk but still conscious/aware of her surroundings, she can consent, it's fair game.

In the first scenario, the woman may have consented, but she had impaired judgement handling the decision, something which the guy may or may not have realized. If he realized that she was drunk and took advantage of her, then I could see that being considered rape. If not, then maybe the guy wasn't to blame.

Now, for scenario two. In this case, both consented on equal grounds. It's worth noting that the woman asked the man for sex, so if anything she was probably more to blame than the guy. But regardless, it's not rape.

So, I guess it's determined based on motives and whatnot.

This. Unless, of course, the other person didn't understand what they were consenting to. But if you're drunk and consent to something, knowing at the moment what it's about, and later come to regret it, it's not rape but a simple mistake from the consenting person.
