I get that Ninten`s policy is stupid and I wish they would drop it altogether, but I hate how Angry Joe acts like he is a victim and makes Ninten seem like a bad guy. He should be well informed about their policies already. What did he expect when he posted Ninten content? Did he expect to be an exception and be allowed to do whatever he wants? That`s pretty stupid to think if that`s the case, especially if he knew this was going to happen. He shouldn`t be acting surprised about this.

Fair use doesn't  mean anything to nintendo. Their Nintendo youtube  program is a testament to that.

There is currently no legislation on whether Lets Plays fall under Fair Use and as such, Nintendo is not doing anything illegal. There have been zero links provided to instances in which Nintendo submitted a copyright claim against a news/review video despite my multiple requests. Youtube's flawed Content ID system (which is distinct from copyright claims) is the cause of false removal of certain videos, but that is more or less out of Nintendo's hands unless they choose to give free reign.

This policy is not a violation of fair use under the current precedent.

Even if I wanted a youtube channel it wouldn't be about gaming, but about antiquity. I don't think the Romans are going to take down my vids.

Assume he makes the low end value, add 5k/yr for a total of 53k because its probably a little bit more than that bottom figure. This site doesn't even take Twitch revenue, sponsorship's, or other common methods like donations into account.
The way the Nintendo's partner program works is Nintendo gets a cut of your end revenue, after youtube and your MCN(Multi-Channel Network) take their cut. So lets say he registers JUST his Nintendo videos videos only and its all of 10% of his content. Nintendo will take a 40% cut on ad revenue for 10% of his videos, 10% of 53000 is 5300. 40% of 5300 is 2120, meaning that after all is said and done he will still make 50,880(which still doesn't include the other revenue options I mentioned before.)
Dunno about you, but if I were doing something I loved and were in a pretty decent financial situation because of that something... a 2k paycut might suck, but wouldn't really be that big of a deal.

Fair Use does not apply to Let's Plays. Short video clips where the sound is muted and you are talking over it constitues Fair Use as a 'parody'. Fair Use also applies to reviews when content from a game is used to review said game. Let's Plays are taking an entirely un-transformed copyrighted work and profitting from it.

lol, actually illegal.

They might be, then they might not be. Nobody wants to bring the matter before a judge because the Lets Players could just as easily lose everything (no revenue, period).

And even if he were as you describe, that wouldn't change the fact that Nintendo us well known for their unreasonable practices on YouTube.  Even people who cover them regularly admit that they have to do a ton of finagling to make sure their content isn't flagged.  Nintendo isn't perfect.  YouTube is a glaring flaw for them.  Everyone knows it.

There is no history.  I've followed him for years.  Just because he isn't a huge, super fan of all Nintendo products does *not* mean his pionts are invalid, nor does it mean that he doesn't enjoy the Wii U games he has played (he has said multiple times INCLUDING AFTER THIS on his Twitch that he really enjoys the Wii U and the games are quite fun; he literally said that the day after the rant).  His points are valid, Nintendo's practices are absolutely asinine.  The vid he put up was well within the bounds of fair use, being a highly edited down playthrough of only part of the game (not a single full session was shown as a matter of fact) with the focus on the commentary and his interactions with the rest of the people playing.  That's essentially textbook fair use.  And by the way, Nintendo knows that it is.  That's why they use the content claim system to syphon revenue rather than issue a DMCA notice.  DMCA is a preemptive to legal action, the YouTube claim system is just an easily abusable way to syphon revenue without having to actually needing to have the balls to go to court.
