Forums - Microsoft - Microsoft Banning Xbox Owners for Fraudulently Refunding Destiny

So let me get this straight... these people were trying to lie to Microsoft by turning in a digital game, yet they didn't know that their Gamertag made them easily identifiable for a possible ban? What was their train of thought?

I do agree with them getting banned for committing fraud. While revoking their titles was a little over the top, it makes sense since the account is no longer accessible.

These ppl are the reason why I can't take advantage of price match, easy return anymore. They will just abuse every right of a customer and eventually let us lose such rights.

It is interesting to me to see how the fanbase of the system that is largely responsible for timed exclusivity is reacting to Destiny's timed exclusivity deal.

Well we clearly have different moral standards.

if you make an insurance claim and the insurance company pays it but later finds it is fraudulent they will ask for the money back and then report you to the police. Is the insurance company at fault?   Just because it is a game and some silly brainless gamers it isnt any less serious in my book.

I say again, they were trying to obtain cash by lying.  Its fraud, they get what they deserve.

Um, the insurance company doesn't take away goods you paid for though.

You violate the terms of your agreement (xbox live) you deserve to have your goods/services (xbox live) taken away.

The insurance company doesn't sell goods... It sells services, and if you defraud them on one policy, they retain the right to cancel all other policies...

Consequently, XBL is also a service, and games purchased are service as well... They have every right to refuse continuation of service to anyone breaking the contract...

This is probably more of a deterrent against copycats considering to use that trick as well, rather than actually banning gamers who've already used that trick.

I am pretty sure there would be regions where banning users for the refund would be illegal.

For instance, if I were to state that "Product was not as advertised" in my refund and Microsoft banned me, I would be able to take legal action as Microsoft cannot override my consumer rights which protects consumers from false advertising.

That's what I mean, actually banning masses of gamers for "fraudulently refunding destiny" seems like quite a juristical risk, for it seems quite hard to really PROVE that a specific case was fraud. If over here someone would get banned for this and he would sue Microsoft for it in court, I believe Microsoft's chances of winning would be low. I cannot believe that Microsoft would actually even resort to this strategy over here, it seems way too risky. Maybe in a few select cases where it's really obvious, but that's it.

But people who - after hearing about people successfully refunding destiny - consider refunding their copy as well might get a bit scared now and refrain from that idea. So I believe that this is the primary motivation behind this announcement .

^^ Exactly. (AR) The announcement ends the fraud.

Actually banning them permanently seems excessive imo. Find a middle ground or it's 'The Evil Empire Strikes Again'. No way M$ should be refunding the entire cost because someone feels lied to. Bungie and Acti got a big slice, even ddl has costs and there was a damn beta. Couldn't they form some idea of the initial $60 offering?

I'm a digital buyer. Slightly disappointed but I'm still way over 200 hours. There is something disturbingly addictive about this framework or template of a full game.

Thats what you get for buying a pig in a poke.

And if they now get banned = good. Noone is at fault but them for jumping on hype trains and buying stuff based on hope/believe/and hearsay.

Should have bought it for the PS4 instead then :)

Regardless of the platform, you'll find buyer's remorse.

That game is gonna win awards for being so disappointing.

I am so disapointed I cant stopped playing it close to 2 months after release. How long did Forza last you?

You can shout it as loud as you want that no one liked it, but that does not make you right. 60-70% or my friends list who got the game week one are still playing it. And any night I log on I can expect to have 25-30 friends on and at least 20 of them playing Destiny.

I spent a good number of hours with Forza but it didn't motivate me to buy Destiny. I bought Destiny because I'm a fan of Halo. Games I've played much more than Destiny and will continue to play with Halo:MCC.

You're making presumptions. I'm not denying people enjoy Destiny. But I'm saying Destiny might be the most disappointing game ever. Bear in mind that isn't synonymous with worst game ever.
