I am pretty sure there would be regions where banning users for the refund would be illegal.

That's what I mean, actually banning masses of gamers for "fraudulently refunding destiny" seems like quite a juristical risk, for it seems quite hard to really PROVE that a specific case was fraud. If over here someone would get banned for this and he would sue Microsoft for it in court, I believe Microsoft's chances of winning would be low. I cannot believe that Microsoft would actually even resort to this strategy over here, it seems way too risky. Maybe in a few select cases where it's really obvious, but that's it.

But people who - after hearing about people successfully refunding destiny - consider refunding their copy as well might get a bit scared now and refrain from that idea. So I believe that this is the primary motivation behind this announcement .
