Homebrew and R4 cards should be legal, and protected. I'm not a fan of Nintendo's "crackdown" on such devices. At the same time, Nintendo should also be free to block unlicensed software for it's closed platforms by whichever means don't violate consumers rights (ie: firmware updates, encryption, etc)... the judge was right on one comment, wrong on the other.

Though the idea of "open" consoles is interesting. It'd probably hurt Microsoft and Sony more than Nintendo the end.

What you don't seem to understand is the negative implications this could have. Nintendo fought hard back in the 1980's to get consoles closed in the first place. Back on the Atari, anyone could make a cartridged game and sell it. Nowadays, that would be like having no piracy protection on a platform at all. This is where court decisions like this lead us back to. Today we're protecting homebrew makers by allowing flashcarts. Tomorrow we're protecting homebrew makers by allowing unprotected DVDs and BluRays to access our consoles. It's the exact same thing. The flashcarts are carts produced outside of Nintendo's control that screw with the piracy protection they have set up. We allow this to pass, and next we witness a bunch of consoles with as much piracy protection as the Dreamcast.

Yes I agree it could have it's negatives, but if you've been a part of the homebrew scene for as long as I have and have seen all of the wonderful ideas and great programs these talented individuals have made you would see just how many positives it brings as well.

I am sure there are ways around this other than trying to block out everything at once. Sony did it with Linux which they unfortunately did away with. I still have access to homebrew on my PS3 without any access what so ever to piracy.

Why not just have Nintendo themselves release a Homebrew only flashcart for the DS? I am sure they can create on that disables the ability to run pirated retail games.

 

Like I said, I am sure there is some other way around it than to try and shut everyone down.

B) However this applies for Sony and Microsoft too... If upheld it means licensing fees go bye bye... as does Loss leading platforms.

Which means we'll never see a PS3 again.  Well unless they wanna sell it for the 800-900 it cost at launch + shipping.

 

If this goes worldwide... or even most of europe.  Expect console generations to last... well generations.

That's actually the part that worries me about this ruling. I don't think the judge thought his decision through at all. That provision certainly seems entirely unnecessary to this case.

That's actually the part that worries me about this ruling. I don't think the judge thought his decision through at all. That provision certainly seems entirely unnecessary to this case.

Well on the bright side... if it happens the PS3 lasting 10 years has a real shot.

Since there is no reason to aim for cutting edge technology.

When instead it makes more sense to go like the Wii... and take half steps technology wise.



Didn't Nintendo also lose a similar case last month in Spain?

I use my PS3 primarily to play PS2 games.

My favorite Wii games is a Wii/PS2 multiplat.

Until I moved I regularly hooked up my Atari to play.

I really wouldn't care much about it if it were the case.   Though the question would be... how would it effect console viability vs PC viability.

Since PC specs would race past console specs even more then they do now.   Would people migrate to PCs and their more advanced graphics, or would more and more games "stay behind" when it comes to graphics.

 

That and you'd wonder if an Atari situation would build up.  Since it would get cheaper and cheaper to get games more and more people would get into it.  People think the Wii has a lot of shovelware now...

Could be the case. I just care as long as the games I want keep getting made, doesn't matter what platform.

As long as something like this doesn't stop my Final Fantasy's and other JRPGs I really could care less. Though honestly I have no clue on what a decision like can or will do in that case, though judging by what is still made for the PC I probably shouldn't worry too much.
