Homebrew and R4 cards should be legal, and protected. I'm not a fan of Nintendo's "crackdown" on such devices. At the same time, Nintendo should also be free to block unlicensed software for it's closed platforms by whichever means don't violate consumers rights (ie: firmware updates, encryption, etc)... the judge was right on one comment, wrong on the other.
Though the idea of "open" consoles is interesting. It'd probably hurt Microsoft and Sony more than Nintendo the end.
