No they wouldn't. Microsoft bought Rare. And, unlike the Goldeneye fiasco, Banjo Kazooie belongs to Rare and thus Microsoft.

Also, it is confirmed that the price will be $40 for Nuts n Bolts. This is an all around good deal. How could any 360 owner pass it up?

you are asking "How do you know?" The game is announced for XBLA and it is coming. I guess Rare and MS made sure they are allowed to publish this game.
