Nah. Legal doesn't equal right.  They are morally in the wrong here.  Nintendo loses nothing from the use of their music on Youtube, as they aren't selling the music, nor does it seem likely that they ever will.  But, by taking it down, the channel owner and all of the people that would view the videos and/or listen to the music lose.  So, they are literally taking from everyone for absolutely no reason.

It is their property and thus their choice.  It is that simple.

Don't like it, don't support them.  That is your right.  Just because you want something doesn't mean you are entitled to it.

Very simple here folks.

Law is not the arbiter of right and wrong.

Ok.  Good luck in court telling a judge the law doesn't matter, your moral right does.

The fact is you don't own it, Nintendo does.  It isn't your decision, it is Nintendo's.

Thank you for this excellent post.  Yes, not all laws are just and so morality and legality intersect but do not always overlap.  I personally believe that copyright law is deeply flawed and needs to be re-conceptualized for the 21st century.

Yes, it is within Nintendo's power.  They made a scummy decision.  That's the whole point.  Obviously they have the power to get it taken down, otherwise this thread wouldn't exist.

Also, I didn't say the law doesn't matter.  I said just because the law says something doesn't make the thing that is says right.  Laws have (and still do) say all kinds of absolute garbage.  Owning other humans, for example, has never been right.  It was legal though, and still basically is in some places.

The fundamental flaw in your argument is morals are largely subjective.  You can't apply your morals to others, and vice versa.  Many here in the States think homosexuality is immoral... but they shouldn't get to force their opinions on others.  So you can think Nintendo is immoral all day long, but that means literally nothing.  When I say it is their right, I am correct.  It is their legal right, full stop.

Except the nice thing about a democracy is that laws can (and sometimes should) change.  Yes it's Nintendo's right to sue some poor bloke into bankruptcy for uploading ROMs or taken down a Youtube channel that was causing no harm, but it is totally my right to say that this is unjust and call for laws to change.

I never said it wasn't your right to do as such, in fact said pretty exactly that a few posts back.  You guys are well within your right to intentionally not give Nintendo any of your money until they do what you would like them to do.  Fair is fair.

My thoughts on it depends on what Nintendo does next. If they "killed" this youtube channel because they are going to start uploading their own music to youtube/youtube music. Then to me it makes sense. While it "sucks" for the creator of the channel, he clearly didn't ask for permission.

If Nintendo doesn't re-upload the music onto youtube, then this is pretty lame. Sure it's Nintendo's music but many people want to listen their music on Youtube and it becomes a distribution problem. While they are well with in their right, I think it's pretty lame.

You are arguing with nobody. At no point did I state that they don't have the legal right to do it. I said it's a shitty thing to do. That's a stone cold fact, full stop.

Lol, I said Nintendo owns it and it is their right (obviously legal).  You engaged me.  I didn't start the discussion, you did.
