My thoughts on it depends on what Nintendo does next. If they "killed" this youtube channel because they are going to start uploading their own music to youtube/youtube music. Then to me it makes sense. While it "sucks" for the creator of the channel, he clearly didn't ask for permission.
If Nintendo doesn't re-upload the music onto youtube, then this is pretty lame. Sure it's Nintendo's music but many people want to listen their music on Youtube and it becomes a distribution problem. While they are well with in their right, I think it's pretty lame.
