What if somebody only wants to experience the story of a game, and therefore will not purchase the game they would otherwise purchase because they can watch it online? Does that not hurt the developer/publisher, who created said content and did not receive money? The cutscenes took people's time and efforts just as much as the gameplay. People were paid to produce said story, cutscenes, music, etc. 


Video game requires human interaction. Story driven games is an exception, but when you're showing gameplay, most of the time people will ask about the game because they want to buy it.

Two things, Nintendo is very smart in how the use content ID. Nintendo by the way isn't doing anything legally wrong, so you can't say why doesn't someone sue them. Content ID program was implemented for this exact thing.
It is however ethically wrong, because the rest of the industry supports the opposite tactic of letting them be. (Indie companies are made on youtube). However I will say Nintendo is also very smart, in the sense they do allow the popular youtubers to not suffer from their own policies. So Nintendo is being really clever and sort of a dick at the same time.

Add: Joe comes off entitled in the video.

I have a feeling you havent watched most of his videos and just jumped straight to conclusions. He has had rants about XBox One DRM, Arkham Origins Bugs, Battlefield 4s Crashes and Ground Zeros just off the top of my head. Most his reviews feature Corporate Commander poking fun at the greed of most publishers. Also his reviews are anywhere from 30 to 45 minutes long, he goes indepth to make sure you dont waste any money and have a good idea of what to expect in a game. Personally I would have loved to see him review a Nintendo game, it would be a breath of fresh air amongst all the rhetoric from both fans and haters.

They don't do it for reviews/news typically. They do it for letsplay. Also it is ContentID, it is always ContentID. Most gamers don't know what ContentID is.

This is the guy that made his fans buy him a WiiU, because he doesnt have enough money with 2 millions subs on his channel. And yet he hasn´t review any of its games. Because is too much for him share a piece of the revenue of 2 videos per year to make happy the few Nintendo fans on his channel, specially the ones that paid him a WiiU. Instead he make videos feeding the haters to earn audience. Awesome.

He got his fans to buy him a Wii U? What a fucking parasite, perhaps he ought to get a proper job. I dont get paid to play Nintendo games so why should this clown.

That is exactly my point. Lets Play falls into a gray area with fair use (and Long Plays fall even closer to black) and their really isn't any precedent on how to handle these cases. Eventually something will come up, but until then it needs to be handled on a case by case basis.

Additionally, ContentID is an automated system and any videos that falsely get taken down are likely flaws in Youtube's sytem, which is a highly flawed system. These problems are on Youtube's end, and there really isn't a ton that Nintendo can do about it other than giving people free reign.

I think that without a legal precedent, something needs to give on the Youtuber's end, although I don't think Nintendo's strategy is particularly good...



While I don't stand for either side, I am amazed at the amount of people who are just down on letsplayers making money and lively hood.



 

I both of them are to blame here. No doubt Nintendo's copyright practises are backwards and counterproductive as fuck but AngryJoe himself is a cheap bastard. He went through the entire 7th gen without a PS3 claiming he didn't have the money to buy it despite having well over 1m subs.
