There's no way Nintendo can brick your console with that. They know pretty well that they'd better not do that on purpose, as it's a mindfield for lawsuits. They have no right to brick your console, that's considered like a faulty product. Unless you modified your console, because then they can say YOU are the cause of the console failure. But putting any CDROM or DVDROM in the console shouldn't brick it.
That's precisely why they included a notice before update, warning people who modified their console, that they can brick their console with an update. Thus, they prevent any lawsuits from smart modders.
The only thing they can do, is prevent the freeloader from running by detecting it. Which I doubt they can do, but who knows. IMHO, the only way for them to do that, is through new hardware revisions. Of course, that actually depends on how Datel implemented this.
This thing is not at all illegal, and that's actually region coding which is illegal. For now, console makers get away with it in Europe, but for example, DVD players must have a way to remove region coding in Europe, that's why you can remove region coding from any DVD player in Europe. I hope a lawsuit is launched for Blu-Ray too.
Anyway, I'm eager for this to come, as I'll surely buy it, to then enjoy all these japanese games that will never be out in Europe, and some american versions, like No More Heroes, which I won't buy in Europe.
Nintendo of Europe is full of fail anyway, and I never wanted to support them, but had to because the Wii is for all the family.
