Forums - General - German exchange student shot in Montana for entering man's open garage.

I was wondering what people thought of this story. My take it is incredibly sad. It sounds like the homeowners purposefully set up a trap and planned to kill pretty much anyone who walked in. From what I've read it seems like the shooter created a human mouse trap. I've seen a lot of people criticise the teenager for trespassing and it is still not clear what he was doing there. I think this will be a controversial case. What's your take?

Mr Kaarma, a 29-year-old firefighter, has told investigators his home had twice been hit by burglars, and he told a hair stylist he had waited up at night to shoot intruders, prosecutors said.

On the night of the shooting, Mr Kaarma and his partner Janelle Pflager left their garage door open, and Ms Pflager left her purse in the garage in order to bait intruders, she told police.

They set up motion sensors and a video monitor, prosecutors said.

When the sensors went off just after midnight and they saw a man on the monitor screen, Mr Kaarma went outside and fired a shotgun into the garage without warning several times.

It is unclear what the teenager was doing inside in the garage.

Mr Kaarma's lawyer said his client planned to plead not guilty.

The state allows residents to protect their homes with deadly force when they believe they are going to be harmed, said his lawyer, Paul Ryan.

"We know with no question the individual entered the garage," Mr Ryan said. "Kaarma didn't know who he was, his intent or whether he was armed."

He said that there had been a spate of break-ins in the neighbourhood and Mr Kaarma did not think the police were doing anything about them.

Wow, just wow. I don't know if this was possible in any other country in the world. The guy had the absolute intention to kill. It doesn't even matter what the man was doing in the garage. Waiting for people with the intention to kill is just wrong.
They even had him on video so his intention should've been able to see through that. And shooting without warning is another thing.
There is so much wrong with this that it just can't be justified with "I am allowed to shoot anyone on my property."

The only thing that can stop some guy lured in a open garage is some guy with a gun firing without warning

...nah, doesn't really work.

“It appeared that there had even been demonstrations to thank Big Brother for raising the chocolate ration to twenty grams a week. And only yesterday, he reflected, it had been announced that the ration was to be reduced to twenty grams a week. Was it possible that they could swallow that, after only twenty-four hours? Yes, they swallowed it.”

- George Orwell, ‘1984’

A guy here in Minnesota(USA) was just convicted for killing two teens that had entered his home. We have a similar law to what is stated in the article. This guys home had been invaded/burglarized multiple times in the last year. The only real reason this guy was convicted was that he had an audio recording of what occurred and it was obvious that he was never in any real danger. The recording even had him shooting the teen and grumbling when his next shot was a misfire. He then went for the kill shot.

It is near the end of the end....

Karma is a bitch

Instead of seeking to convince others, we can be open to changing our own minds, and seek out information that contradicts our own steadfast point of view. Maybe it’ll turn out that those who disagree with you actually have a solid grasp of the facts. There’s a slight possibility that, after all, you’re the one who’s wrong.

I could happen in pretty much any country in the world.

The only thing shocking about it is how forthcoming he was with having baited the person.

The title makes it sound like the teen just happened to be in the wrong place at the wrong time.

I was more alluding to the fact that he will probably not go to prison for this.

It's the same law in Germany as it is Montana.

In Germany this would be at least 5 years in prison up to life long. It wouldn't even matter that it was on his property. It wasn't self defense. The fact that it was a trap and he was going in with killing intent makes this an even stronger offense. There are no laws that protect people from shooting other people. Even in self defense this would be highly scrutinized.

I doubt he will be convicted in the US because in the US there are laws that protect shooters.
