Whereas Nintendo of Europe is located in Germany and therefore under german law MS and Sony are located in the UK and under british law

The only thing you can blame them for is being located in Germany. Of course they have to follow the german law. A website also has to follow the law of the country it is located, no matter where the users come from :D

I doubt that its a good enough excuse for most consumers Come on, you have to admit it that its an arhaic and BS law, and ONLY Nintenod can be blamed for it.
