Easily, and it's not just MS that does it, almost all online games would ban you love before 34 forced name changes. It doesn't even require that you sign any ToS - If you go into a movie theatre and start using obscene language loudly enough, and for long enough, you will be forced to leave and will not be given a refund.

they arent deleting the games off his harddrive.  he can still play them. 


But he can't transfer or redownload them, even though it was advertised that he could when he bought them? Still looks actionable to me.

I would like to know his other gamertags to see how bad they were.  And really, have we become the generation of the offended?  People talk this way with their friends in joking coversation all the time.  It's not like he used curse words or had the gamertag "iliketorapeunderagegurls" or went around trolling people on Live.  I just don't understand MS positions on "offensive" people.  Of course, this doesn't exactly surprise me.  They are the same company who banned a girl from Live for saying she was gay.
