I suppose I should clarify something about property. Physical formats are considered to be Masters. Digital downloads are considered to be Copies. It is legal to sell a Master, but it is illegal to sell a Copy. A master by its nature carries ownership. There is no way to confer ownership on a copy. You can copy your master, but you most definitely cannot sell the copy. You must be able to physically transfer the ownership with a legal device. You cannot knowingly disseminate material that is harmful to minors. The names this one user was using were pornographic in nature. There is a lot of latitude in this area, but with 34 instances it plainly shows intent to engage in criminal behavior. When you game on Live you know you are doing so in the presence of children. That means you must conduct yourself in a censored manner.
Yes I know that most kids on Live are foul mouthed little dicks, but that doesn't mean as an adult your civic obligation is just rescinded. Your position grants you additional privileges, but that comes with responsibilities. I am just plain glad that this twerp is gone. With this kind of disdain for the rules one shudders to think how he behaved within the service. I am not having a hard time imagining this guy trying to cyber with children.
The guy deserved the ban. Not because his gamertag was offensive, I couldn't care less about that, but the fact that he ignored MS 34 times taking them for granted. MS has shown a lot of patience in that regard, and lets say if I was notified of an offensive gamertag I would have been extra-cautious about my next gamertag so as to not get banned.

that plus it is because of morons like that, that we end up with so many rules to follow.... if people were acting in a more civilized manner we would have to restrained ourselves more than necessary....
and about digital rights... you were first to it.... but I'm supprise nobody said it first.... I man it has been old and DRMs issue have been brought to court in the past.....especially in the case of MP3 dowload on apple store and stuff like that... cause people couldn't do copies for there car CD player or other devices.... but nobody rose the issue with games really.... but it is true that it should.... it should be possible to make a copy of it at least in case you break your system don't have a way to go on internet and can't transfer console to console.... but beside that... I don't really see the issue... you just have to log in on the new consol DL the game and it works.... at least it does with me and my XB back in France at my parents house and the one I have here in the US.....
now the situation for the guy is debatable.... but I can easily see a judge throw the case away even if he has one... just because of the 34 chances.... at the end of the day legal or not the judge decides and for such a low profile case.... it's not like he is going to get in trouble for doing it (the judge)....

yeah but no.... for many reasons, first if they were going fully digital with the same right as physical.... they'd save on production cost for the box packaging and the CD (without counting the press etc) which could then be seen as a lower price ( you can already see that with music or movies Vs the retail price of the physical disc in some cases)
but also the fact that a CD DVD or Blu ray are probably the wost way to store and save data over a long period of time a VHS, DATA tape, or an old floppy disk have longer life expectancy than those crapy digital support.... one of the reason I beileve BLU ray is the shittiest step up (HD DVD too for that matter) in storage format we had since mini disk....
and finally just for the sake of the planet... less plastic=less carbon emission and just for that digital is the smartest way.....
the real issue is not which is better..... because digital is clearly the best.... if all ownership laws are equal.... back in the day the same crap was going on with disks.... so just give time the law to catch up and everything will work out....
conclusion smart people get together into consumer groups to find smart solution.....
