And saying that doesn't defend Nintendo's decision, I hate that the lawsuit is around patents, I think patents suck and are a negative impact to progression but the fact is a patent lawsuit is a lot easier than a copyright lawsuit and Nintendo is almost certainly going to win this. Nintendo has one of the best legal teams in the world and have been preparing for months. Can't see this going anywhere other than a settlement in Nintendo's favour or Pocketpair being crushed by legal fees.

So yes it turns out that Microsoft not acquiring Pocketpair was a huge dodged bullet.

Actually, I think if MS acquired Pocketpair then Nintendo would've probably thought twice about that suit. Because that this is a patent suit instead of copyright/trademark infringement is already telling: they haven't found any copyright/trademark infringement. Patents can be much broader but are also much more unrealiable as a result in court. This lawsuit could end in these patents getting revoked.

But I think the more likely intention here is for Nintendo to not even get to court, but to endlessly eat time and money of the opponent through proceedings and then drop the lawsuit just before it actually made it to court. That is not unusual for patent cases.

So, what if Microsoft had acquired PocketPair? Microsoft has an army of lawyers so any tactic of overflooding them with judicial proceedings would be answered by even more judicial proceedings from Microsofts lawyers. This is a game they know and play all too well. More importantly: Microsoft holds enough bullshitty software patents of their own and as the nature of broad software patents is their lawyers would dig up potential infringements in Nintendos games in no time. So effectively Microsoft would just completely Stonewall such a legal attack by Nintendo.

As Nintendo knows this I am certain they wouldn't have sued in the first place, had MS acquired PocketPair.
