The difference between this one and most other ones, is that actually develop and produce products that uses their patent, not to mention license it.

Looks like Nintendo is going to have to settle on this one if they can't prove that their technology is not similar to this one. I always wondered what company make those funky kids tv games and did Nintendo license the idea. I guess not...

It says that this case in in the district court of maryland, but I am unable to find it; is anyone more adept than I am at finding it? I'm trying to find which patents they're allegedly infringing on so i can form an opinion, and am having a hard time getting info.

My gut reaction, though, is that they're going after the wrong people. A recent court case involving a company suing multiple upstream providers over the same patent recently established that if company A infringes company B's patent by licensing it to company C, then B can only sue A, not C.

However, I would *really* like to get more info before I form a solid opinion on the matter.

I do not think these guys can sue Nintendo. The gyroscope was developed by another company.
Therefore that company is the one that must be sued. Oh wait, I forgot my business law. You actually sue the company that has the most money. At least this is what I think.

Ok, so searching into Hillcrest Laboratores' patent holdings... *most* of the possibly-applicable patents are very new.

This one i feel is the most likely, and as they filed it in December of '06 Nintendo has about a month's head start on them for the purposes of prior art, not even counting the fact that they probably have patents of their own that were filed before release.

This one is also likely, and was filed May, 2007. I think they're even more SOL on that one through prior art.

They might be hoping on this one or this one , but the first is seemingly irrelevant, and from what we know of the Wii remote it doesn't follow the behavior indicated by the second, which would lead me to believe that it wouldn't infringe.

All their other patents are design patents, which I can make no claim on because for some reason I can't see the images on the USPTO's website.

I think it's sad that Nintendo is now getting sued for a second time for "playing a tennis game like your swinging a tennis racket" or "playing golf like your swinging a golf club" - pretty sad that you can seem to patent real life actions.

LOL @ America, that countries going to sink faster than a cement filled plastic bag, Anascape opened a whole can of worms, that judge needed to mitigate the penalty based on duration and exhuastion of the patent.

What's the point of innovation if everyone can sue you for doing it first.

On the civilian level the judicial system in America has always been screwed up, that's the reason they pay so much for anything medical, then complain about it. Wouldn't be suprised if people end up paying 350 for the Wii eventually over there.

The constitution is great, but all the little litigations here and there need to be rethought, that country is hurting itself in a bad way... now it's spreading.
