I agree that you shouldn't kill yourself for a job, but it takes courage to go out like this because depending on the companies they won't hire you because they expect you may do this against them.

Yes. Absolutely. Kojima was still officially binded to the company, meaning he is still a representative of the company. A company has the right to protect their image. You can get fired for posting negative things about people or the company  you work for. I dont know if you have ever had a job, but a situation that escalates to human resource level or involves attornies always ensures that they are to remain silent about the issue and may not even be allowed to return to work untill the issue is resolved.. Its the same here.
