Tumblr users are starting to receive notices regarding the removal of fan art from blogs following takedown requests from Nintendo. The company is taking issue with art that is pornographic in nature. Details about the situation beyond this are unclear. Gaming Reinvented posted an article last month about how someone without the proper authority (outside of Nintendo) has been issuing takedown notices. We can’t say that this situation was a fake claim as only the company was included in the email, and not a specific name. It’s enough to cast some doubt on this though, and should be taken with a grain of salt unless more information is provided. If it is a fake claim, then that’s a pretty big issue. Tumblr in that case would be removing content without verifying the DMCA sender.

Fruitless battle, but honestly I think it is fair for them to protect their IP.

As long as any official names weren't used or any content copied straight, there shouldn't be any problem with any kind of fan art, be it porn or something else. I don't think creating art inspired by something itself is a problem no matter what kind of art it is. But if some names (e.g. Pokémon) were used without permission or if any content (such as models, textures etc.) were directly stolen, this is obviously justified.

I'd like to point out that in Blizzard's case, assets (e.g. models) were directly stolen from Blizzard's creations (e.g. games). Of course it seems that we don't know whether that was the case here, but considering how most fan art doesn't steal assets, it's probably reasonable to assume that none were stolen until we get more information.

It makes sense. Especially for a company that wants to maintain a family friendly image.

If you read that claim carefully, it's almost glaring how fake it is.

Nintendo of America does not hold the copyright to anything.  They belong to Nintendo Co., Ltd.

"We are contacting you because Nintendo IP's Characters on the profile" ... I don't know who's supposed to be writing this but the person managing the Nintendo twitter account has more professional writing than this.  

"[...] harmful to the brand and without Nintendo's consent" Again, more terribly worded, unprofessional speech.  Not to mention a run on sentence.

Why is chracters capitalized throughout the whole paragraph?  And who the hell is "Mark"?

Actually, I just thought of something. Maybe this fake claim is an attempt for someone to trick Tumblr into giving him a bunch of links to free unofficial Nintendo porn. It wasn't me.
