There isn't enough information in those scenarios to say really. How drunk are the people?
If she is really drunk and your sober? Yeah, that's rape. If she's just tipsy, than she would still have here wits about her and can make her own decisions.
If you're both a little tipsy, then the same applies as if just she's tipsy. Neither of your are too drunk to give consent to it's fine.
Now, it gets complicated if you're both really drunk. Technically, under the strictest terms of the law, it's rape. BUT either party could claim that they were raped because they were both too drunk to give consent.
It's an interesting question though.

the point is that there are people all over the place who when given the chance will harm other people... therefore, anyone who wants to be safe must take precautions
its really very simple

now we can act on the two sides in this - the rapist and the victim
how do we stop psychopaths from raping though? do you have special goggles you can use to scan people and deterrmine their intent?

well obviously we have to work from the side of the potential victim... so what can potential victims do to stop themselves from being victimised?

uhm obviously it depends on how drunk you are
if you've hd some drinks and are just acting ridiculous or silly but are somwhat coherent and jump into bed with someone then who cares. if you're talking about someone jumping the bones of another who is practically passed out- then that probably could be considered rape
of course I would argue it depends upon the relationship of the two people as well. if its a total stranger who's insanely drunk and you jump on top of them then you're being pretty stupid and are potentially forcing them into something because it's not as if a tots drunk person generally can express themselves that well
This idea that women have no agency in these situations and therefore all responsibility must fall on men is getting pretty prominent now
the thing i truly find amusing is that a lot of the men pushing this agenda don't seem to realise that they are going to fall victim to unwarranted abuse as this idea becomes more and more prominent and more and more measures are put in place to strip responsibility away from women
anytime someone brings this up programmed drones who obviously have not sat down to think about this for a bit jump out and yell "victim blaming!" "victim blaming!" without realising ironically that stripping all responsibility women have for these situations away from them is pretty damn oppressive and disempowering
you are basically telling women that they are passive objects who have no say in their destinies... it is all up to men to determine what happens in these situations... they have no say

Exactly. Just because someone is super drunk doesn't mean anything. It's an excuse for predators.
It depends if the other person remember it and enjoy it, if not, then it's rape

I don't talk for all of VGchartz, as much as I would like to be, I don't talk for everyone on here. Still though if you have something to say about this post rather than VGchartz posters as a whole would love to hear it, I'm sure at some stage when someone is going out for a walk late at night you've uttered the comment "mind yourself" without having them return to attack you for victim blaming if something happens.
