A few things need to be said. First, there never was, at least to my knowledge any exclusive agreement between Sony and Konami over Metal Gear Solid. Hideo Kojima chose to stick with the PlayStation consoles. Even if there was an exclusive agreement over the PlayStation MGS, no where in that agreement would it have ever said "for all time". Also, prior to the MGS remake, a non-canon MGS game had already been made for the Game Boy Color and an Xbox port of Metal Gear Solid 2 was made.
As far as Nintendo and Banjo is concerned, yes, Nintendo had attachements to Banjo. The Banjo games were going to be an extension of the DKC universe. However, Nintendo gave up those attachements when they let Microsoft purchase the 51% of Rare that was owned by the Stampers. Nintendo probably could have fought to keep the rights to Banjo but chose not to most likely because of their good relationship they still had with the Stampers and because they wisely knew well enough that an IP is sometimes only worth something if the people who created it were still around to do something with it.

Banjo would be a great move for both Nintendo and MS. It supports a toon that both sides love and MS also don't mind Nintendo having there IPs since both Conker and Banjo have been released on Gameboy in the past. Maybe a future Banjo/Conker game on 3DS? And it allows more hype for Banjo Threeie. Hope Banjo gets in Smash, he deserves to be, his one of the most loved toons in his day.
