They have to power to do whatever they want.. Sorry.. Indie games are NOT system sellers. It is the benefit of the Indie developer to be on X1.. NOT Microsoft.. They are allowing indies to SELF publish and use all the resources a big developer can, and sending many developers FREE dev kits.. If you are sending FREE stuff to developers, might you NOT want something in return? It sure wont be a huge cut of money.. as most indie games sell for $15 or less.. and don't sell in great numbers..
Would you rather have 15 million audience or 10 million? That is the choice of the developer.

I would argue that even small to mid-size projects made by bug publishers will sometimes skip the XB1 due to ressources constraints, and the thing is, this very specific one, or any other by itself may not be the argument to buy x system, but all of them together have an influence.
If the studio is small and cannot afford one or more programmer specialized on XB1 at the same time as they develop the other versions (or the project's scope is too small, for things like P.T. or some Japanese games do not see it as relevant to release simultanously, because xbox is not important there, like in most territories)... well these games will skip, and these are only the few reasons I can think of on the top of my head, some will just not bother... because if you account Steam and the PS3/Vita in the equation as well XB1's relative importance becomes a rounding error.
