Absolutely unbelievable that people are saying to keep this policy. That makes no sense to me. It's a big company trying to strong-arm small developers. There is no way in which that does not suck. It reminds me of the crap Nintendo pulled during the SNES era, with their policies that made developers bend over backwards.
If you love Microsoft more than you love the games themselves, this clause is for you. Otherwise, it's a bad thing. Well, unless you want Microsoft to pick out which games you can play or not, then I guess it's fine. Personally, though, I like to do that myself.
