Mario Kart 8 disc in the system, system sent in for repair, came back without Mario Kart 8.

Actually no.
If I remember correctly, his game was freezing in particular tracks. So he called up Nintendo and they acknowledged the issue, and told him to send in the game disc as they would replace it. But alas, he got back an empty case.

Well THAT'S interesting... If the game was freezing, what made them think it was the game disc? If the game disc is damaged enough to cause freezing, you can see this physical damage on the disc.
Though, if he sent in the game disc and didn't get it back, that really is kind of funny 
I mean, it's sad and all, but as other's have said, it's the avatar's fault.

That would have been class if it was some just perfectly dark plastic texture looking disk to make it look empty.... but yeah less class paying 50euros for an empty box with no insane centurions in it!
