police and insurence company said you are at no fault and the family of the bikers sued you for over $1mio.
hope that they lose the lawsuit or like she countersue if you lose the first lawsuit so that you dont go bankrupt ?

but what about 50kph ? could the accident be prevented ?
what about 30kph ?

but I dont think you can expect them driving 30kph just because there could be a bike with no light in front of you.

if they were pedestrians than the driver would be partly at fault, but were i live a bike with no light and relevant reflectors are fully at fault if the driver was driving by the rules ...

you can have perfect eyesight. if something pulls in front of you with no light at a badly lit road you could still hit it even at slow speed.
thats why you cant expect anything. you have to expect that the others are also keeping the law.

thats why usually if a bike pulls in front of you with no light and you hit it its usually the bikers fault. if you drive accordingly.

If you want to kill yourself on hitting a deer and blame the deer for it, good plan. You can't simply expect everything to follow the rules. Speed limits are limits, not minimum driving speeds. You should always reduce speed to match the circumstances.

Killing yourself on a deer is still better than living with the guilt of killing someones child. Accidents happen, but driving 90 in the rain at night is not responsible behaviour. I always slow down when passing cyclists, a simple gust of wind can blow them in your path.

what would I do? I wouldn't sue someone I f#ckin ran over and killed + their families. what kind of idiot would even think of trying that? if it was an actual accident, just leave it like that.

I would sue my insurance company if they're not willing to pay for liability claims.

of course you should reduce your speed where its needed. but even if you reduce your speed and a deer jumps in front of you you will most likely still hit it or crash trying to drive around it. 

I think i answered it to expect everything as able to stop in time. if something jumps 5-10meters in front of you you can only drive 10kph and still hit it.
doesnt mean you need to drive 5kph only.

and yes 90kph is not responsible, i wouldnt do that.

i dont think they have to pay if you are not at fault.

but yes sueing the victims family is not right.

maybe, but you and me might change our oppinion if we would lose the lawsuit and have to pay $1mio+

but losing it is unexpected, expecially when every other one is saying that you are at no fault.
