In most countries cyclists ALWAYS have the right of way, same with pedestrians.
Drivers are protected by steel, plastic and other alloys, cyclists and pedestrians aren't, thus by extension, they should logically have priority of the road to ensure their safety.

A few years back, I had a silly old bat drive me off the road while I was on my motorbike, thankfully being a dirt bike it wasn't much drama as I do plenty of bush bashing anyway, but what if it was a kid on a push bike?
Thankfully she was also advertising her car for sale, so I got the phone number and gave her a piece of my mind.

I think this accident had less to do with right of way. It is inherently dangerous to cycle on a 50 mph / 80 k/h road with no streetlights at 1:30 AM.

She was speeding. No clue how bad the rain was, but at night on an unlit road she should not have been going 90.

  • Lower your speed in bad weather, in heavy traffic or in a construction zone;
  • Slow down when driving at night, especially on unlit roads;

When riding at night, bicycles must have a front white light, a red rear light, side reflectors and a red rear reflector

Both parties were at fault, but in the case where one ends up dead and the other with a dented car, the majority of the responsibility shifts to the one driving the car.



this will have to be dropped as the national(and probably international) outcry willbe too great....I mean really, sueing the family of the parents of the child you killed and left cripple, they're no words to describe how deplorable this is!!!

not only does ontario have reflector and helmet laws(both of which were broken) it also has a law about parents letting kids break either of those laws

Can anyone confirm if she was with her headlights on?? And if she tried to slow down or deviate??? Because by the look of it it seems like she didn't even saw the boys. Because doesn't matter how close you are when seeing (and with the headlight even tough the reflection was minimal she should have saw them from at least what? 50 ft?) you will try breaking and deviating, so it would have some tyre marks indicating that. Now if you are drunk, typing, speeding and with headlights off it would be possible to just smack down without seeing.

it is also very possible that at 130 in the morning on a foggy rainy night, on-coming lights could drown out the much darker objects infront of you.  we already know a 3rd vehicle was there right away.
