We went back through this about the Australian lady who struck a cyclist and acted all indignant that she had her license suspended over it. If you're walking on the road and you get hit, god help the person who hit you, no matter what you were doing. If you're a cyclist, then god help you, pretty much no matter what they were doing unless they were intoxicated.

That said, this is egregious. The family should countersue for emotional damages brought on by her audacity.


the family is already sueing her,  they filed the first lawsuit last year for 900thousand in damages.

 is it decent to sue the lady whose going through the emotional distress from an incident that even a full investigation finds she is not at fault?

Some people here apparentely have no idea of Legal system. Let me just say that for criminal charges you must be guilty beyond all reasonable doubt (and since they never done the exam to determine alcohol in the organism), but for civil actions you may sue on the assumption that the other party could have done a better job on avoiding the situation.

So yes, the family could sue her for reckless drive even if she wasn´t sollely at fault in the case (which is impossíble t determine how much at fault the lady was if the full investigation wasn't conducted). And she could sue the boys that survived, but suying the family of the dead makes no sense at all since they weren't even remotely involved in the accident.

Next she will sue the car maker to allow the car going 90 km/h on dark. And I still don't understand where the boys failing to brake contributed to the accident? The only thing braking would cause the boys to be met by the car faster and with more kinect energy against them (probably killing the other boy). Maybe she wanted to say she failed to brake.

So I did some research and the crash seemed different that I initally imagined.

There are no streetlights in sight, which would explain the poor visibility.

The speed limit implies that it is something like a rural highway.

Drivers are protected by steel, plastic and other alloys, cyclists and pedestrians aren't, thus by extension, they should logically have priority of the road to ensure their safety.

A few years back, I had a silly old bat drive me off the road while I was on my motorbike, thankfully being a dirt bike it wasn't much drama as I do plenty of bush bashing anyway, but what if it was a kid on a push bike?
Thankfully she was also advertising her car for sale, so I got the phone number and gave her a piece of my mind.

Doesn't matter, I'm unaware of any laws stating you aren't allowed to travel on 50+mph roads with no street lights at 1:30am.

If you drive a car then you should always try your best to be aware of other people on the road, regardless of time or conditions.

If you ride a motorbike or a bicycle you should always ride with the mentality that no one can see you on the road, your life is more important than someones vehicle.
