A trade mark is different then a copyright. The trade mark in this case is probally the Title they use on the box art. It doesn't mean much just that they don't intend to re-release the title anytime soon. It would be different if they allowed the copyright to expire.

I wouldn't, they still can get you. The copyright didn't expire just the trade mark, and technically trademarks really don't need to be registered it just adds another layer on what they can sue you for. (For example the lawsuits where developers sue over fonts used for titles because that is what trademarking does.)

OT: Played it on the xbox and it was kind of cool. I got to say i enjoyed watching the dvd that came with the game, explaining the story of Shemue 1, a bit more. For those craving more Shenmue, just play Sleeping Dogs. The combat is more fluid too.

Uhm.. Copyright is automaticly.. When you create a work its copyrighted for your life and 70 years after your death.. that one is about not getting your created work being copied, stolen or used by someone else.. a trademark is for doing business with a name, logo etc..
getting the trademark cancelled is because SEGA isn't doing anything with it.. the name Shenmue is no longer a "brand" that Sega has..
anyone now can use the term "Shenmue" in a videogame now.. like Shenmue Saga, Shenmue Ultimate and even Shenmue 3..
Copyright only protects stuff that is created..
Basicly Sega is saying the Shenmue Franchise they created is death

Shenmue's Story was pretty good that why I think most fans wanted a 3rd game. The level of interactivity made it feel alot less than GTA in China which is what sleeping dogs feels like. Can't just walk around beating people up, you have to get a job or gamble, and even learn how to fight, something I haven't seen in any other open world since.
Shenmue 1 + 2 where like old 80's action kung fu movies. Definetly one of my favorite games on the OG Xbox.
Especially the Boss fight.
