Because it is socially acceptable. Some things have existed so long thjat people are treating it as tradition and would never let go. 2nd hand market is inherently harmful to businesses but it has always existed, so it stays. Something being legal does not represent its morality.

Compare it with smoking. If smoking didn't exist and someone would introduce it today, it would be immediately banned because it is inherently harmful to everything. But smoking is legal despite its harmfulness just because it has been around for so long and as such is socially accepable.

You could argue that 2nd hand is accepted because it's pro-consumer but that's bull. Nobody cares about consumer protection or things would be different around here.

Second hand market is good to the environment, though, since it effectively recycles things that would be discarded instead. Not to mention it benefits both the buyer and the seller, one because it gets a lower-priced product it might otherwise not even have acess and the other since it gets money from something without any further use.

Since you paved the way for such insane exercise of logic let's say nobody ever thought about it but today someone came up with the brilliant idea of reseling stuff it bought once already (could the supply chain even be conceived before that?). I can't honestly fathom how you possibly can believe it would be banned instead of flat out winning the Nobel prize on economy and being lauded by the Greenpeace and the like as a planet saviour.

And the law might not be the same as ethics or morality but it's definitely intertwined with both and as such tend to reflect the prevailing views of a certain society. No law is intrinsically dissociated of a moral value. In democracies if something is "wrong" enough to a majority of people it will eventually become illicit. Thankfully, the rest of us don't see anything wrong with the freedom to sell your own stuff.

They seem to be selling every high-end, higher-profit GPU they make.
So it's good for them in that regard.

If the second hand market was to be abolished then allot of brick and mortar stores would simply fold... Along with a chunk of the brand-new physical market.
They go hand in hand.

If a developer wants people to buy their product brand new, then they need to simply provide value-added incentives. - I have literally pre-ordered a game because of a cool statue.

Sword Art Online: Fatal Bullet announced, coming in February
http://www.pcgamer.com/sword-art-online-fatal-bullet-announced-coming-in-february/
Back in August, Bandai Namco teased something called #Projekt1514, which was later revealed to be a new Sword Art Online game set to come to the PC in 2018. And that, I'm assuming, is what the publisher announced today as Sword Art Online: Fatal Bullet, "an original story supervised by series creator Reki Kawahara" scheduled to come to Steam on February 23, 2018.

Destiny 2 dataminers uncover secrets, surprises, and spoilers

Destiny 2 finally came to the PC yesterday, and of course dataminers immediately dug into it to see what they could foretell of its future. One, a redditor named TheEcumene, found quite a bit, including voice lines referring to new worlds, Destiny 1 patrol zones, the Prison of Elders, and a number of other things that—fair warning—may well be minor (or major) spoilers.

PUBG's deadlier blue zone has arrived: the farther you are from safety, the more damage you take
http://www.pcgamer.com/pubgs-deadlier-blue-zone-has-arrived-the-farther-you-are-from-safety-the-more-damage-you-take/
PlayerUnknown's Battlegrounds' blue zone is now deadlier than ever thanks to a new patch, and the further you are from the safe zone on the map, the more damage you'll take over time. That won't apply to the first circle, though, which means you'll still be able to hike a fair distance in the blue zone early on and live to tell the tale.

Skateboard turf-war game Decksplash will grind into Early Access on November 10—but only if 100,000 players try it out for free during the preceding week. If it doesn't reach that milestone, then the game is cancelled. Seriously.

The Battlerite community isn't thrilled with its new objective-based 'battlegrounds' mode (Updated)
http://www.pcgamer.com/the-battlerite-community-isnt-thrilled-with-its-new-objective-based-battlegrounds-mode/
Battlerite is an action-oriented multiplayer game that's all about teamfights. It's something of a MOBA spinoff: there are no creeps to farm or towers to defend, just enemies to kill, which is a system we very much enjoyed. But in a recent update, developer Stunlock Studios has taken the game in a different direction.
Update: In a statement, Battlerite game director Peter Ilves confirmed that casual arena will return.

The second hand market is that big because it is allowed to exist, not because it's so great for everybody. If second hand trade had been banned or made undesirable by creators then stores wouldn't fold because no store would build their business model on it.

Second hand has the exact same negative consequences for creators as piracy yet one of the two is supported and the other shunned. You just cannot completely condemn piracy for denying money to creators and then go on to laud second hand trade. It's backwards.

Well. We will never know untill 2nd hand games are banned. :P

But considering that Gamestop etc' have been struggling despite the higher profit 2nd hand sales recently...

Well. No.
Second hand still entices people to buy DLC, Microtransactions, Expansion packs, Season passes and so on.

Pirated games usually include all the above or none at all and is often even locked out from having any of those things.
