If it was legitimate (which I would doubt) I would bet that the biggest bidders would be the modding community ...

Having a working development kit with full documentation for the system would give them a massive head start in bypassing the system's security; and within months of the system launching they might be able to have a working modchip for the system.

I kinda doubt there is a line in the contract that says "feel free to sell this stuff if you like".
I'm more inclined to think the confidentiality contract contains a paragraph that tells the signer what would happen if s/he gave away info (or the entire system..). And the contracts I signed usually had 6-7 figure penalty numbers in it..
