Looks like your conclusion contradicts Joel's research (which I honestly haven't read). Saves me some time, so I'll just agree with you.

at least this time, that would seem to be the sane thing to do

the reason I used that particular phrasing is because there is something a bit suspicious about the whole deal. For example the website for touchfactor hasn't changed at all since it went up, and still looks like something that was pulled together in 30 minutes. I suspect there is more going on beneath the surface but any indication that the company is actively involved with Nintendo is at this point pure speculation. Articles on the subject from recent years even go as far as mentioning neither LucasArts nor Nintendo wanted to hire Factor 5 becuase of the massive debts they were in.
I'd be thrilled if Nintendo worked out a deal with them and got them back working on Wii U or 3DS, but this is purely wishfull thinking.

You are Forgetting Factor Y media group. Which is also related to Factor V which are both essentially the same company. Also after the Factor 5 studios closure in 2011 the studios founders went to court to maintain Factor 5 owned the rights to Turrican. In fact their are currently four studios which comprise Factor 5 which is very much still a living entity. You can find info on it at NeoGaf but you can also find info else where on the inter webs.

Oh one last thing you say a year ago. But the studio in its Factor 5 form was still very much alive still fighting for its Turrican IP in August 2011. In fact when NeoGaf and other outlets and forums finally confirmed the studios complete demise in November 2011 it turns out Factor Y Media Group and the conglomerate of Studios still exist. In fact Factor Y media group has also gone by the name Factor V pronounced Factor 5. The company never completely died nor was the content it made officially disposed to our knowledge.

All four current studios including the official Factor Y remain in tact and operational. I do have to wonder the legality though. How can you close a studio and go bankrupt and not pay empyrean and shutter. Two times and still be operating? For more confirmation check CEO

Check Achim Mollars LinkdIn profile and read up. The Factor 5 company is still alive through its many break away studios. But technically through Factor Y (Factor V) as well as the other studios. If you wrote a topic a year ago or anywhere close a lot has happened since. In August was the court cases and Factor 5 was still alive represented by its key players and November was when people began to acknowledge its full death see Neo Gafs thread. Yet Factor V or Factor 5 or Factor Y what ever you call it is still alive and the CEO is still CEO and the company while it hasn't made any announcements is alive. We also do not know about the content the remaining staff could still finish it. As I said five of them could make a WiiU game no problem since 2008. If they already had a ton of content made for Rogue Squadron 4 it too could have been completed or be completed by the few remaining staff assuming Lucas Arts didn't order it terminated.

The company is alive.

Like I said, I'd love for it to happen, but not getting any hopes up. There seem to be too many problems in the way:

You've got the closure of the American branch (which if you look into it, you'll find was where all the work was done), the multiple lawsuits and the massive debt, on top of that it was reported in different sources that LucasArts and Nintendo didn't want to work with the company, and worst of all most (if not all) key players have moved on.

Even if Moller manages to pull together a group of developers under a similar name, they will not be the same group of people who made the RS games stand out.

edit: Regarding FactorY, Factor V etc, I glossed over those details when I mentioned the "remains of Factor 5" as they seem to be essentially the same entity with different fronts, probably becuase of some complex legal mess. There is also (was also) the company known as Blue Harvest/White Harvest, essentially another front established by Moller.

Frankly many of the guy's business practices seem too shady to me to bring about any meaningful result.

A 5 man team who also have had a tumultuous time with legal trouble and cenceled projects etc. I wouldn't expect much more than a small downloadable game from them with current hardware with a 5 man team even if they have lucasArts backing.

I seem to remember something on that line. Maybe Nintendo did what they did with Retro and "bought" a commanding share. Or made a contractual agreement like they did with Silicon Knights.
