the reason I used that particular phrasing is because there is something a bit suspicious about the whole deal. For example the website for touchfactor hasn't changed at all since it went up, and still looks like something that was pulled together in 30 minutes. I suspect there is more going on beneath the surface but any indication that the company is actively involved with Nintendo is at this point pure speculation. Articles on the subject from recent years even go as far as mentioning neither LucasArts nor Nintendo wanted to hire Factor 5 becuase of the massive debts they were in.
I'd be thrilled if Nintendo worked out a deal with them and got them back working on Wii U or 3DS, but this is purely wishfull thinking.
