That's Terrible.

all this shows is that the 3DS is still backwards pirate compatable.

this does not mean 3DS is hacked, just means you can play your hacked DS games still on the 3DS. 

Guess when nintendo makes things backwards compatable, they truly do, lol.

I'd assume that the Acekard and R4s would still work perfectly to play DS games. They will have to make newly updated ones to run 3DS games, if it is possible to do that from a flashcart

Oh God, someone understands how it works. Guys, it's retro-compatible, it plays DS games, it's obvious at the launch it'll play flashcards. Do these flashcards support 3DS games? No! Will these flashcard be banned with the first update? Yes! And hackers won't just have another firmware just like on the DS, they'll obviously have to work harder.

Actually it's very possible that some kind of pirate flashcard will come out this year, but as long as there are silent and obligatory updates and there's not the possibility to install a custom firmware to prevent this things you just won't be able to use your 3DS properly (won't play last 3DS games, won't support online play), so no problem for Nintendo.

Also you should add CoD BO for the wii. They are basically the same game right?(your words somewhat twisted with mine)

I heard a rumour that 3ds games cant even be copied from the cartridge.

They'll figure it out... they always do.
