The short note was from Everything Nintendo. On the Adriasang site it says "The event page says that children under six will not be allowed to demo the games at the event in 3D due to the possibility of long term adverse affects on vision development. Nintendo notes that this is a concern not for the 3DS alone, but for 3D visuals in general. "

My guess is that this is similar to the Epilepsy warning for video games, it's a possuiblity they need to legally protect themselves against though the chances are probably not high.

The muscles in a childs eyes at that age are still developing. I think it's more than just a legallity however the last thing Iwata wants is to sign all those checks in a class action lawsuit. ala The Jerk
