They own it the only issue is NA because Reggie and co never brought the game over, operation rainfall lead to XSeed publishing it in NA instead meaning in NA the latter holds the publishing rights to the game but the IP ownership is held by Nintendo.

Nintendo does? OK. I was not sure, because sometimes it is strange with second party. For instance Another Code wasn't owned by Nintendo (and Reggie also denied Another Code R, which is also an amazing game). Nintendo only later bought the rights when cing was bankrupt.
